The short version: be cool, don't break things, and our signed contract always beats anything you read on this page.

/01Acceptance of these terms

By using this website, requesting a bid, or sending us a message, you agree to these terms. If you do not agree, please do not use the site. We may update these terms; material changes will be highlighted on this page for 30 days and the "Last updated" date at the top will change.

/02Use of this site

This website is provided for prospective and existing clients of Silver Creek Electric, Inc. to learn about our services and request bids. You agree to use it for lawful purposes only and not to attempt to disrupt, automate at scale, scrape, copy substantial portions, or reverse-engineer the site or its underlying systems.

/03Bids, estimates, and proposals

Pricing posted on this site or referenced in early conversations is for budgeting purposes only and is not a binding offer. A binding bid is one that (1) is signed by an authorized estimator on company letterhead or signed digitally through an authorized e-signature platform, (2) references a specific drawing set or scope document by date and revision, and (3) lists scope, exclusions, assumptions, and an expiration date. Verbal quotes are conversation, not contract.

/04Contract precedence

Where your project has a signed contract, change order, or AIA-form agreement with Silver Creek Electric, Inc., that contract governs the project. Nothing on this website overrides, modifies, or supplements a signed contract — even if the wording here is more or less favorable to either party.

/05Payment terms (general)

Standard commercial work runs on Net 30 from invoice date unless your signed contract specifies otherwise. Progress billings are submitted monthly per the project schedule of values. Past-due amounts may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by California law. Mechanics' lien rights are preserved per California Civil Code §§ 8000 et seq.

/06Project photography and case studies

Project photos and case studies on this site are used with permission of the owner, general contractor, or design team. If you believe an image or description was published in error, email us and we will review and remove or amend within five business days.

/07Trademarks

"Silver Creek Electric," the lightning-bolt mark, and "Do It Right. Do It Once." are trademarks of Silver Creek Electric, Inc.. IBEW, NECA, OSHA, NFPA, NETA, ICC, OSHPD, HCAi, and other third-party marks belong to their respective owners and are used here only to identify standards or affiliations.

/08No warranty on web content

We work to keep the information here accurate and current, but we do not warrant that everything is error-free, complete, or up to date. Code references, AHJ requirements, lead times, and pricing change frequently. Final scope, code compliance, and pricing are always confirmed in your signed contract and current drawings.

/09Third-party links and services

This site may link to third-party resources (manufacturers, code references, mapping services). We do not control and are not responsible for the content or practices of those sites. Following a link is at your own discretion.

/10Limitation of liability

To the maximum extent allowed by California law, Silver Creek Electric, Inc. is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of this website. Our aggregate liability for any claim arising from website use is limited to one hundred US dollars (USD $100). Liability for project work is governed exclusively by the signed contract for that project.

/11Indemnification

You agree to indemnify and hold Silver Creek Electric, Inc. harmless from any claim arising out of (1) your misuse of this website, (2) your violation of these terms, or (3) content you submit through forms or email that infringes a third party's rights.

/12Force majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control — including natural disasters, utility outages, labor disputes outside Silver Creek Electric, Inc., government action, fire, flood, or pandemic. Contract dates extend by the duration of the event.

/13Privacy

Information you submit through this site is governed by our Privacy Policy. We do not sell your information. See the Privacy page for the full detail.

/14Governing law and venue

These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of these terms will be heard exclusively in the state or federal courts of Santa Clara County, California, and both parties consent to that venue.

/15Severability

If any provision of these terms is found unenforceable, the remaining provisions stay in full effect, and the unenforceable provision is reformed to the minimum extent necessary to make it enforceable.
